Services we offer

Bitrails provides two categories of service: web development (marketing websites, custom web apps, AI integrations, retainers, codebase audits, and platform migrations) and ads management (search and social ad campaigns and reporting). The exact services for your project are defined in your written scope, not in these terms.

How we work together

Every engagement starts with a written scope of work covering what will be delivered, the timeline, and a fixed price. We do not begin billable work without an agreed scope. Any changes to that scope — new features, added pages, extra revisions — are handled as a separate written change order with its own price, not folded silently into the original quote.

Payment

We invoice according to the schedule set out in your scope of work (for example, a deposit before starting and a balance on delivery). Invoices are payable on the terms stated on the invoice.

We do not charge interest or late fees on overdue invoices. If an invoice is not paid on time, we simply pause work on the project until the outstanding balance is settled, and resume once payment is received.

Intellectual property

Once you have paid in full for a project, you own the deliverables created specifically for you under that scope of work (for example, your website's design, content, and custom code). Until full payment is received, ownership remains with Bitrails.

This does not extend to our own pre-existing tools, internal frameworks, or third-party and open-source libraries used to build your project — those remain governed by their own licenses and are not exclusive to any one client.

Warranty

For 30 days after a project launches, we will fix, at no additional charge, any defect in the delivered work that does not match the agreed scope (for example, a broken feature or a bug in code we wrote).

This warranty does not cover new features, requested content changes, or issues caused by third-party services outside our control (for example, a hosting provider outage, an API change, or a platform policy change). Work outside the warranty is scoped and quoted separately.

Limitation of liability

Our total liability for any claim arising from a project is limited to the amount you paid us for that project. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data, to the extent permitted by law.

Governing law

[Jurisdiction — to be confirmed] These terms are governed by the laws of that jurisdiction, and any dispute will be handled in its courts, unless otherwise agreed in writing.

Changes to these terms

We may update these terms from time to time. Changes apply to new engagements from the date posted; active projects are governed by the terms in place when the scope of work was signed.
